1. Acceptance of Terms

By downloading, accessing, or using Nida, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app.

2. Age Requirement

You must be at least 13 years old to use Nida. By using this app, you represent and warrant that you are at least 13 years of age. If you are under 18, you represent that you have your parent or guardian's permission to use the app.

3. Description of Service

Nida is an AI-powered application that helps users generate personalized du'as (Islamic supplications) following the Prophetic tradition. The app also allows users to save, organize, and set reminders for their du'as.

4. AI-Generated Content Disclaimer

Nida uses artificial intelligence to generate du'as. Please understand:

• AI-generated content may occasionally contain errors or inaccuracies
• Generated du'as are meant to follow Sunnah structure but should not be considered religious rulings
• Users are encouraged to verify religious content with qualified Islamic scholars
• We continuously improve our AI but cannot guarantee perfection
• The AI does not provide fatawa (religious legal opinions)

5. Religious Disclaimer

• Nida is a tool to help structure du'as according to the Sunnah
• It is not a replacement for Islamic education or scholarship
• We recommend consulting qualified Islamic scholars for religious guidance
• Users are responsible for their own spiritual practice and religious decisions
• The app is meant to assist, not replace, your personal connection with Allah

6. User Responsibilities

• Provide accurate account information
• Maintain the security of your account credentials
• Use the app respectfully and lawfully
• Not attempt to harm, exploit, or reverse-engineer the service
• Not use the app for any unlawful or prohibited purpose

7. Account Terms

• One account per person
• You are responsible for all activity under your account
• You must notify us immediately of any unauthorized use
• You can delete your account at any time through the app settings

8. Subscription and Payment Terms

Nida offers both free and premium subscription tiers:

• Free Tier: Basic access to du'a generation and saving features
• Premium Subscription: Full access to all features including unlimited generations, advanced reminders, and more
• Subscription prices are displayed in the app before purchase
• All payments are processed through the Apple App Store

9. Auto-Renewal Terms

Premium subscriptions automatically renew unless cancelled:

• Your subscription will automatically renew at the end of each billing period
• You will be charged within 24 hours before the end of the current period
• You can cancel auto-renewal at any time through your Apple App Store account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial subscription periods
• Refund requests are handled according to Apple's refund policies

10. Intellectual Property

• The Nida app, including its design, features, and content, is our intellectual property
• Your personal du'as and content remain your property
• You grant us a license to store, display, and process your content to provide the service
• You may not copy, modify, or distribute any part of the app without permission

11. Service Availability

• We strive for consistent availability but do not guarantee uninterrupted service
• We may update, modify, or discontinue features at any time
• Scheduled maintenance will be communicated when possible
• We are not liable for any service interruptions

12. Prohibited Uses

• Using the app for any illegal activities
• Attempting to breach security or access unauthorized areas
• Harassing, threatening, or harming others
• Using automated systems or bots to access the service
• Reverse-engineering or attempting to extract source code
• Misrepresenting your identity or affiliation

13. Limitation of Liability

• Nida is provided "as is" without warranties of any kind
• We are not liable for any spiritual or religious interpretations made using the app
• We are not responsible for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the service in the past 12 months

14. Indemnification

You agree to indemnify and hold harmless Nida, its creators, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the app, your violation of these terms, or your violation of any rights of another party.

15. Dispute Resolution

In the event of any dispute arising from these terms or your use of Nida:

• You agree to first attempt to resolve the dispute informally by contacting us
• If the dispute cannot be resolved informally within 30 days, either party may pursue formal resolution
• Any legal proceedings shall be conducted in the courts of Canada
• You waive any right to participate in class action lawsuits against us

16. Termination

• We may terminate or suspend your account for violations of these terms
• You may delete your account at any time
• Upon termination, your right to use the app ceases immediately
• Provisions that should survive termination (like limitation of liability) will remain in effect

17. Changes to These Terms

• We may update these terms from time to time
• Material changes will be notified via email or in-app notification
• Continued use after changes constitutes acceptance of the new terms
• If you disagree with changes, you should stop using the app

18. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Canada, without regard to its conflict of law principles.

19. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
